General Terms and Conditions

1. Introduction

These General Terms and Conditions ("Terms") govern your use of the Indian Drive Guide mobile application and website (collectively, the "Platform") and all related services provided by Indian Drive Guide ("we," "our," or "us"). By using our Platform, you agree to comply with and be bound by these Terms.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. If you are accessing or using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Account Registration

To access certain features of the Platform, you may need to register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain all rights in, and are solely responsible for, the content you post, upload, or otherwise make available through the Platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with providing and promoting the Platform.

5. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or infringe other people's intellectual property, privacy, or other rights
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform
  • Attempt to gain unauthorized access to parts of the Platform not intended for public access
  • Use the Platform to transmit viruses, malware, or other malicious code
  • Engage in any harassing, intimidating, predatory, or stalking conduct
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Collect or store personal data about other users without their express consent
  • Use the Platform in any manner that could disable, overburden, damage, or impair the site

6. Intellectual Property Rights

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Indian Drive Guide, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. QR Code Usage

The QR codes generated through our Platform are intended solely for the purposes of vehicle identification and contact facilitation as described in our service offerings. You agree not to use the QR codes for any illegal, fraudulent, or unauthorized purposes. We reserve the right to deactivate any QR code used in violation of these Terms.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by Indian Drive Guide. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Indian Drive Guide shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Indian Drive Guide, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Platform, including any direct, indirect, special, incidental, consequential, or punitive damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless Indian Drive Guide, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

11. Modifications

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Bangalore, Karnataka, India, and you hereby consent to the personal jurisdiction and venue therein.
